1. Introduction
This document sets forth the Terms and Conditions of Use governing access to and use of the Movilytics platform (the “Platform”), owned and operated by Pragxis Ltda.
Movilytics is a Data as a Service (DaaS) web-based system providing processing, storage, and analysis services for public transport data, including planning, operations, and data visualization modules.
By registering, accessing, or using Movilytics, the User fully agrees to these Terms. If the User does not agree, they must refrain from using the Platform.
2. Definitions

| Service Owner | The entity responsible for operating Movilytics. |
3. Registration and User Account
- Users must provide accurate and up-to-date information.
- Users are responsible for maintaining credential confidentiality.
- Passwords are stored encrypted and cannot be retrieved in plain text.
- Users are responsible for all activities under their account.
- Movilytics may suspend or delete accounts in case of misuse.
4. Subscription Plans and Billing
- Plans include Free, Premium, and Enterprise tiers.
- Pricing and limits are detailed on the official website.
- Billing may be monthly or annually.
- Failure to pay may result in suspension.
5. Data Access and Use
- Data may originate from public sources or institutional agreements.
- Access depends on subscription level.
- Redistribution or commercialization without authorization is prohibited.
- Users retain ownership of uploaded data.
- Movilytics may use anonymized aggregated data for improvement.
6. Intellectual Property
- All software and content rights belong to the Service Owner.
- No intellectual property rights are transferred to Users.
- Reverse engineering or derivative works are prohibited.
7. Privacy and Data Protection
Movilytics complies with Chilean Law No. 19.628 and, where applicable, GDPR.
Personal data is encrypted in transit and at rest. Users may request access, rectification, or deletion of their data.
8. User Responsibilities
- Use the Platform lawfully and ethically.
- Do not interfere with system operation.
- Do not attempt unauthorized access.
- No bulk extraction or denial-of-service attacks.
9. Limitation of Liability
- No guarantee of uninterrupted availability.
- Use is at User’s sole responsibility.
- No liability for misuse of data.
- Liability limited to amounts paid in the last 12 months.
10. Amendments
Movilytics may update these Terms at any time. Continued use implies acceptance.
11. Suspension and Termination
Accounts may be suspended or terminated for violations, misuse, or non-payment.
12. Governing Law
These Terms are governed by the laws of the Republic of Chile. Disputes will be submitted to the courts of Santiago, Chile.
